Cape Talk, Sunday morning

Good morning, I'm Ori Li Kalinga. Chairperson of the Inter-Ministerial Committee on Migration, Minister Mamoloko Kubai, says government will approach the courts to seek a supervisory order on the implementation of the Constitutional Court judgment on asylum seekers. This follows violent protests surrounding the ruling and the subsequent Home Affairs Directive to process the applications of asylum seekers regardless of how they entered the country. Kubai says, following legal

Consultations, government has been advised to return to court and seek an order that will allow the judiciary to retain oversight over the implementation process. This would also allow the court to provide guidance on how the judgments should be operationalized. Kubai says government may also seek a suspension period to give the Home Affairs Department time to build the administrative capacity needed to implement the ruling. We believe that this approach represents a responsible and lawful mechanism.

To ensure that constitutional obligations are fulfilled in a manner that is orderly, practical, and in the public interest. It will allow the government to avoid administrative disruption while ensuring that the rights recognized by the court are progressively and meaningfully realized. Meanwhile, Deputy National Police Commissioner Tebelo Musikidi has warned that security forces and the army remain on high alert in Gauteng and Kozulu Natral and will not allow intimidation to paralyze.
