Justice Mbuyiseli Madlanga ruled that Vusimuzi Kat Matlala’s application will be heard on the day, after a tense dispute over his lawyers’ request for more preparation time and threats of a walkout.

The commission heard that Matlala had been given three days to consult his legal team, while commissioners criticised the conflicting positions from his lawyers as “deeply problematic”.

A workplace-boundaries segment argued that employees have a right to rest, managers should use out-of-office messages and buddy systems, and leaders must communicate clearly that after-hours emails need not be answered immediately.
